1. OUR COMMITMENT TO PRIVACY

We are committed to respecting the privacy and security of the personal information of every individual who uses the Triumph Motorcycles website https://shop.triumphmotorcycles.com/ (which we refer to in this Privacy Policy as the “site”, which term also refers to any content, functionality and services offered on or through the site).  This Privacy Policy outlines the information we will collect and how we will use that information, so that you may be informed about how we use your personal information and the choices you have regarding our use of, and your ability to review and change, your information.  This Privacy Policy is applicable to users of the site located in the United States.

When we refer to “you” and “your” in these Terms, we are referring to you as a visitor to and user of the site. “We,” “us” and “our” refer to Triumph Motorcycles (America) Ltd., along with our affiliates. 

2.  CHANGES TO OUR PRIVACY POLICY

Because of changes in Internet technology and practices, this Privacy Policy, and our security and other policies may change from time to time.  Please consult this portion of the site for important changes to the Privacy Policy as they occur.  It is our practice to post any changes we make to this Privacy Policy on this page, but it is your responsibility to check this Privacy Policy for updates.  By using the site after we post any changes to this Privacy Policy, you agree to accept those changes, whether or not you have reviewed them, and such acceptance shall be deemed legally conclusive.

3.  The INFORMATION WE COLLECT

In general, you can visit the site and many of its pages without telling us who you are or revealing any personal information about yourself.  As described below, we may automatically collect certain information when you visit the site, but the data we collect in this manner is limited to “browsing data” of the type described below under the headings “Cookies and Automatically Collected Information,” which we will not use to personally identify you. Depending on how you use the site, we may also collect other information about you. We describe the type of information we collect, and how we obtain it, in further detail below.

A.    Personally Identifiable Information About You.  In general, “personally identifiable information” refers to information that can be used to identify an individual, such as name, email address, postal mailing address, home/mobile number, credit card number and billing information.  We collect this information when you provide it to us, such as when you register for an account on the site, submit information as a registered user or guest when making any purchases through the site, email us with questions through the “live chat” or customer support features of the site, or include personal information in any product reviews or other interactive features of the site. You are in control of providing this information to us, and you are responsible for ensuring that it is accurate, including by providing us with updates when applicable.

B.    Demographic and Other Information.  In connection with your use of the site and/or your purchase of any goods, we may also collect and aggregate information about your characteristics that cannot, by itself, in the absence of any other personally identifiable information, be used to identify you. This includes information such as your age and geographic location.

C.    Cookies and Automatically Collected Information.  When you access the site through a computer, smartphone, tablet or other device, we may send one or more “cookies” – small text files containing a string of alphanumeric characters – to your device. We may use both session cookies and persistent cookies.  A session cookie disappears when you close your browser. Persistent cookies are saved on your device in order to identify you the next time you log into the site. We will also collect certain information automatically when we correspond with you. For example, we may receive an auto-generated confirmation when you open e-mails from us, if your device supports such capabilities.

We may also automatically record certain information regarding the device you use to access the site, such as the browser type, IP address and position, and web pages visited.  

D.    Third Party Collection of Information. We do not expressly authorize the collection of personal information of users of the site for third party use through advertising technologies.  However, some content or applications on the site are or may in the future be served by third parties, including advertisers, ad networks and servers, content providers and application providers.  These third parties may use cookies, alone or with web beacons or other tracking technology, to collect information about you when you use the site.  They may be able to associate the information they collect with your personal information, or they may collect information, including personal information, about your online activities over time and across other website and online services. 4.  How WE USE INFORMATION

A.    Personally Identifiable Information.  We use the personally identifiable information that you provide through the site in order to provide the products and services offered through the site. For example, we use this information for the following purposes:

·         To communicate with you regarding your purchases or your account.

·         To market additional products and services to you through both the site and our authorized dealers in your area, and to provide customized shopping features and promotional offers to you.

B.    Demographic Information. 5.  HOW WE SHARE INFORMATION

A.    Sharing Information to Provide Services.  To enable us to more efficiently operate the site and provide you with our products and services, we may share your personally identifiable information and the other information collected through the Website with our affiliates and with selected third parties who are acting on our behalf as our agents, suppliers or other service providers.  For example, we may need to share your information to parties who fulfill orders, deliver packages, send postal mail and e-mail, provide marketing assistance, process credit card payments, and provide search results and links.  These parties will have access to personally identifiable information as needed to perform their services, but may not use it for other purposes.

We may also share your personally identifiable information with our authorized dealers, so that they can contact you regarding products and services, including those offered through the site and otherwise.

We may provide demographic information (to the extent it does not include any personally identifiable information), and other information collected through the site that cannot be used to personally identify you, to third parties on an anonymous basis. We may also disclose automatically collected information and other aggregate, non-personally identifiable information, to third parties to assist us and such third parties in understanding usage, viewing, and demographic patterns for certain content, services, advertisements and/or promotions.

C.    Legally Required Disclosures. We may be required to disclose specific information upon governmental request, in response to a court order, when required by law, to enforce our website policies, or to protect our or others’ rights, property or safety.  We may also share information with companies assisting in fraud protection or investigation.  Nothing in this Privacy Policy shall be deemed to prohibit us from disclosing your identity or information if we are required to do so.

6.  Your Choices Regarding Your Information

If you visit the site without creating an account or making a purchase, you will not be required to provide us with any personally identifiable information.  However, if you create an account or make a purchase, we will need to collect the personally identifiable information necessary to complete the purchase, and share it with our service providers who help us fulfill orders. If you do not want us to collect, access, use and share this information, you should not register for an account or make any purchases through the site.

You can update, correct, or delete your account information at any time through the “My Account” link on the site. It is your responsibility to make sure that your account information is accurate at all times.

The site may from time to time allow you to submit contributions to the site, such as through product reviews. We may store these contributions, display them to other users, and use them for purposes consistent with the mission of this site. Your submission of any content is voluntary and at your own risk.  We are not responsible for the information that you choose to include in any submissions to the site, including any information that could be used to personally identify you, and we are not required to review your submission or redact any information that you include in it. If you include personally identifiable information in any submission that is made available on the site, it can be viewed and used by any person viewing the site, and therefore your inclusion of any personally-identifiable information in any submission is solely at your discretion and your risk. 

We provide certain tools to manage the use of your information on the site and how and when you may receive communications from us.  You can opt out of receiving non-essential communications from us by notifying us that you do not wish to receive them. However, please note that notwithstanding your email preferences, we may need to contact you as required by law or regarding legal matters.

We do not track users, and the site does not have sharing functionality across the internet, and therefore we do not use or respond to “do not track” signals that you may set on your browser.

7.  Our commitment to data security

We use industry-standard security measures to maintain the safety of your personal information, including measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure.  We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input. 

Unfortunately, no electronic data transmission over the Internet can be guaranteed to be 100% secure.  As a result, while we believe that we use reasonable measures to protect personal information, we cannot ensure or warrant the security of any information transmitted or otherwise provided to or received from us. 

8.  A Special Notice about Children

The site is not directed to use by persons under the age of 13.  We do not knowingly collect personal information from children under 13.  If you believe your minor child has improperly accessed the site and provided any personally identifiable information, or if you have any reason to believe that a child under 13 has accessed the site and provided any personally identifiable information, please contact us.

The site may contain links to other websites with which we have no affiliation.  We are not responsible for the privacy practices employed by other websites. 

10.  Transfer of Business Assets

In the event that Triumph Motorcycles (America) Ltd. is acquired by or merged with a third party entity, we have the right to transfer or assign the information we have collected from you as a part of such sale or merger.
